1. Overview and Parties
These Terms of Service govern the purchase and use of the desktop software EvaGrade Desktop ("the Software"), created and developed by its author Rubén Cancho Gasulla (EvaGrade Software), with commercial distribution and billing managed from London (United Kingdom) through Lemon Squeezy, LLC as our authorized Merchant of Record (contact: [email protected]).
By downloading, installing, activating, or using EvaGrade Desktop, you agree to be bound by these terms. If you represent an educational institution or company, you confirm that you have the authority to bind that entity.
2. License Grant & Permitted Usage
Subject to payment of the applicable license fees, EvaGrade Software grants you a non-exclusive, revocable, non-transferable license to install and execute the Software:
- Multi-Device Entitlement (3 Workstations): Each individual license allows activation on up to three (3) personal or school-assigned computers owned or operated by the educator (e.g., personal laptop, classroom workstation, and home computer).
- Usage Restrictions: You agree not to reverse engineer for unauthorized bypass, resell, lease, sublicense, distribute, or share license keys with unauthorized third parties.
- Educator Supervision: EvaGrade provides AI-assisted draft rubrics and evaluations. The educator retains full pedagogical authority and sole responsibility for reviewing and finalizing all grades before publishing them to Moodle.
3. Pricing Plans & Subscriptions
- Free Trial: Complete 15-day PRO trial with unlimited AI evaluations upon installation. No credit card required.
- Academic Year Plan (Annual): Unlimited AI evaluations, Moodle batch grading, multi-device access, priority support, and all software updates for a period of 365 days from purchase.
- Monthly Plan: Full PRO access renewing automatically every 30 days. You can cancel anytime without cancellation fees or penalties.
4. Merchant of Record & Payment Processing
Our order process is conducted by our online reseller and Merchant of Record, Lemon Squeezy, LLC (222 S Main St Ste 500, Salt Lake City, UT 84101, USA).
Lemon Squeezy manages all payment processing, PCI-DSS Level 1 compliance, tax calculation (VAT/Sales Tax), official invoice issuance, and customer billing support. 5. Refund and Cancellation Policy

6. Intellectual Property
All intellectual property rights, trademarks, copyrights, codebases, algorithms, and documentation relating to EvaGrade remain the exclusive property of EvaGrade Software.
7. Privacy & Data Protection (FERPA, COPPA & GDPR)
EvaGrade is built on a Privacy-First local architecture. All student records, submissions, and grades remain exclusively on your local workstation and your school's Moodle server. No student data is uploaded to EvaGrade cloud servers. Please review our Privacy Policy for full details.
8. Disclaimer of Warranties & Limitation of Liability
The Software is provided "as-is" without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, EvaGrade Software shall not be liable for any indirect, incidental, or consequential damages resulting from third-party Moodle server outages, network errors, or user configuration mistakes.
9. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Spain and the applicable European Union regulations, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved before the competent courts of Valencia, Spain.
